Overview: The following terms and conditions govern your use of the Canobie Lake Park website (the “Site”), Purchasing & Using Tickets via visit.canobie.comPurchasing & Using Tickets via our Corporate E-Tix Program Signing Up for CanobieClub , and Participation in our Product. 

 

Terms and Conditions For Canobie Lake Park Corporate E-Ticket Program 

Overview: The Canobie Lake Park e-Ticket programs allow Park visitors to purchase e-Tickets from our website. The e-Tickets purchased from this Site are for personal, non-commercial use, they are non-transferrable, non-changeable, non-refundable and may not be re-sold. ALL SALES ARE FINAL.

 

Your Obligations: In consideration of your use of the Site, you agree to submit true, accurate and timely information in your profile and account and in all transactions. If we have reasonable grounds to suspect the validity of such information we may suspend or terminate your Account and refuse any and all current and future use of the Site. The information you provide is subject to our Privacy Policy.

A username and password are required to register. You are responsible for maintaining the confidentiality of the password and are fully responsible for all activities and charges that occur in your Account. The sharing of login credentials may result in suspension or cancellation of your Account. You agree to immediately notify us of any unauthorized use of your Account or credit card or any other breach of security.

 

Your Conduct Interacting With The Site: Any conduct by you that in our sole discretion restricts or inhibits any other user from using or enjoying the Canobie Lake Park Corporate e-Ticket program will not be permitted. You agree to use the Site only for lawful purposes. You are prohibited from posting on, or transmitting through, the Site any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, profane, hateful, fraudulent, racially, ethnically or otherwise objectionable material of any kind, including but not limited to any material that encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable local, state, national or international law.

Commercial use of any portion of the Site is prohibited. You agree not to access the Site by any means other than through your account in the interface that is provided by us.

 

Site Content: You acknowledge that the Site could contain information, data, software, photographs, graphics, videos, logos, images, text, typefaces, sounds, and other material (collectively “Content”) that are protected by copyrights, trademarks or other proprietary rights, and that these rights are valid and protected in all forms, in all media and technologies existing now or hereinafter developed. All Content is copyrighted as a collective work under the U.S. copyright laws and we own a copyright in the selection, coordination, arrangement, and enhancement of such Content. You may not modify, remove, delete, augment, add to, publish, transmit, participate in the transfer or sale of, create derivative works from, or in any way exploit any of the Content, in whole or in part. By the fair use privilege under the U.S. copyright laws (see e.g. 17 U.S.C. Section 107), you may not upload, post, reproduce, or distribute in any way any Content which is protected by copyright, trademark, registered mark or other proprietary right without obtaining permission of the owner of the copyright or other proprietary right. In addition to the foregoing, use of any software Content shall be governed by the software license agreement accompanying such software, if any.

NEITHER CANOBIE LAKE PARK, NOR ITS AFFILIATES, NOR ANY OF ITS OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, AGENTS, THIRD-PARTY CONTENT PROVIDERS (“PROVIDERS”), MERCHANTS (“MERCHANTS”), SPONSORS (“SPONSORS”), LICENSORS (“LICENSORS”), OR THE LIKE (COLLECTIVELY, “ASSOCIATES”), WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE; NOR DO THEY MAKE ANY WARRANTY AS TO RESULTS FROM THE USE OF THE SITE, OR AS TO THE ACCURACY, RELIABILITY OR TIMELINESS OF ANY INFORMATION, CONTENT, SERVICE, OR MERCHANDISE PROVIDED THROUGH THE SITE.

Further, we explicitly disclaim any responsibility for the accuracy, content, or availability of information found on sites that link to or from the Site from third-parties. Because some sites employ automated search results or otherwise link you to sites containing information that may be deemed inappropriate or offensive, we cannot be held responsible for the accuracy, copyright compliance, legality, or decency of material contained in third-party sites and you hereby irrevocably waive any claim against us with respect to such sites.

YOU HEREBY ACKNOWLEDGE THAT THIS PARAGRAPH SHALL APPLY TO ALL CONTENT, MERCHANDISE, AND SERVICES AVAILABLE THROUGH THE SITE. BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

You agree to indemnify and hold us and our subsidiaries, Affiliates, officers, directors, shareholders, employees, agents, or other partners harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to, or arising out of, Content you submit, post to or transmit through the Site, your downloads from the Site or from e-mail messages generated by the Site, your violation of the Terms of Use, or your violation of any rights of another.

Export: The U.S. export control laws regulate the export and re-export of technology originating in the United States. This includes the electronic transmission of information and software to foreign countries and to certain foreign nationals. You agree to abide by these laws and their regulations – including but not limited to the Export Administration Act and the Arms Export Control Act and not to transfer, by electronic transmission or otherwise, any Content derived from the Site to either a foreign national or a foreign destination in violation of such laws.

Our Rights: We may elect to electronically monitor areas of the Site and may disclose any Content, records, or electronic communication of any kind (i) to satisfy any law, regulation, or government request; (ii) if such disclosure is necessary or appropriate to operate the Site; or (iii) to protect our rights or property or the rights of the users, Sponsors, Providers, Licensors, Agents or Merchants. We are not responsible for screening, policing, editing, or monitoring such Content. If notified of allegedly infringing, defamatory, damaging, illegal, or offensive Content we may investigate the allegation and determine in our sole discretion whether to remove or request the removal of such Content from the Site.

We may terminate or suspend your access to all or part of the Site, without notice, for any conduct that we, in our sole discretion, believe is in violation of any applicable law or is harmful to the interests of another user, Provider, Agent, Merchant, Sponsor, Licensor, or us.

We reserve the right to refuse to sell e-Tickets or other products to you if it reasonably appears to us that you intend to resell them. In addition, we reserve the right to limit quantities of items purchased by each Account holder.

Links to Third Party Sites: Occasionally, as a convenience to you we may provide a link to a third-party’s web site and it could cause you to leave our Site and enter a different web site. We are not responsible for the contents of any linked site, cookies or downloads generated by third-party sites or any link contained within them. We are not responsible for any form of transmission received from any linked site. We do not endorse the use, functionality, legality or content of third-party sites.

Submissions: If you send us comments, suggestions, ideas, materials, notes, drawings, photographs, graphics or other information (collectively, “Submissions”), the Submissions shall be deemed assigned to us without compensation or further obligation all now known or hereafter existing, and that we shall be entitled to unrestricted use of the Submissions for any purpose whatsoever, commercial or otherwise, without compensation to the provider of the Submissions, including the right to publish on the Site or elsewhere and to use the Submission, including any suggestions, ideas, etc. contained therein.

Applicable Law: We control the Site from within the United States of America. We make no representation that the content in the Site is appropriate or available for use in other locations, and access to it from territories where its content is illegal is prohibited. Those who choose to access the Site from other locations do so on their own initiative and are responsible for compliance with applicable local laws. You may not use or export the Content in violation of U.S. export laws and regulations. Any claim relating to the Site, the services provided through the Site or its Content shall be governed by the internal laws of the state of New Hampshire, without reference to its choice of law provisions.

Termination: These terms are effective until terminated by either party. If you no longer agree to be bound by the Terms of Use, you must cease your use of the Site . Subject to applicable law, we reserve the right to suspend or deny, in our sole discretion, your access to all or any portion of the Site with or without notice. You agree that any termination of your access to the Site may be effected without prior notice, and acknowledge and agree that we may immediately deactivate or delete your account and all related information and files in your account and bar any further access to such files or the Site. Further, you agree that we shall not be liable to you or any third-party for any termination of your access to the Site.

Delivery: To purchase e-Tickets on the Site, you must have a shipping address in the United States or use an APO/FPO U.S. military address. All transactions are in United States dollars. Purchases from the Canobie Lake Park Corporate e-Tickets Program are acknowledged automatically via email with instructions as to how e-Tickets can be downloaded via Adobe Acrobat Reader®.

 

TERMS AND CONDITIONS FOR SEASON PASSES 

 

Refund Policy: A Canobie Lake Park Season Pass is a revocable license and may be confiscated at any time with no refund of purchase price. Season Passes not used during the season are void. No refunds or credit will be given for unused Season Passes.

Sharing Policy: Canobie Lake Park Season Pass cards are non-transferable and may only be used by the specific individual to whom the Season Pass was assigned. Any attempt to gain admission to the Park using a Season Pass by a Guest to whom it was not originally issued will result in immediate termination of the Season Pass without refund or return. Season Passes cannot be resold. Reselling or attempting to allow another person to use your Season Pass constitutes theft of services from Canobie Lake Park. Any future attempts to obtain a new Season Pass may require a written explanation, personal meeting or security investigation.

Conditions of Entry: Canobie Lake Park reserves the right to cancel, suspend or revoke any season pass and deny admission at any time for any reason without notice or a refund. A Canobie Lake Park Season Pass is valid for only one entrance per valid day, and a re-admission hand stamp is required for same day re-entry. A Season Pass does not include admission to park areas not open to the general public. The cost of food, merchandise, games, pay-per-experience attractions, and special events are not included. A Canobie Lake Park Season Pass allows access to all rides (unless restricted by conditions which could ultimately prohibit someone from riding safely, including but not limited to height, weight, age, physical limitations such as pregnancy and heart conditions, or observed appropriate behavior), and shows and attractions on any regularly-scheduled operating day of the season. Please be advised that not all rides and attractions may be operational on the day of your visit and may close for weather conditions and mechanical issues.

Suspension: If a Season Passholder is suspected of violating any of these terms, any other rules, regulations or policies of Canobie Lake Park, Canobie Lake Park may suspend the Season Pass held by such person subject to Canobie Lake Park’s investigation of the alleged violation. Canobie Lake Park will not refund the Season Passholder during any such period of suspension. Upon the conclusion of the investigation and depending upon the findings of such investigation, the suspended Season Pass will either be reinstated or immediately revoked.

ID Cards: A physical Canobie Lake Park Season Pass is non-transferable, non-refundable, non-exchangeable, is not valid for cash, tickets, merchandise or credit cards of any kind and remains the property of Canobie Lake Park.

Replacement Pass: If a Canobie Lake Park Season Pass is lost, stolen, destroyed or forgotten, the card can be replaced for a non-refundable replacement fee of $10.00. If your Season Pass is lost or stolen please immediately report to Guest Services or call (603) 893-3506.  Minors must need to be accompanied by a parent or guardian to receive a replacement Season Pass.

Upgrades: Guests within Canobie Lake Park may be given the opportunity to upgrade their current day’s ticket for a discounted rate. This fee is subject to change at any time.

Age Restrictions: Canobie Lake Park reserves the right to require that individuals 15 years of age or younger are required to attend with a parent/guardian/adult.

Updating Your Information: Changes in address, phone number and/or email address can be made at the Canobie Lake Park Welcome Center.

 Photo Identification: Each Program Participant must have a photo associated with his/her account for identification purposes. A Season Passholder must have a valid Pass and a proper photo on file with Canobie Lake Park to grant admission. At this time, adults must replace their photos every three (3) years and children (under the age of 18) must update their photos every year. Further identification may be required at turnstiles or any in-Park point of sale upon request.

 

GENERAL TERMS AND CONDITIONS 

 

Refunds & Returns: All ticket products, season passes and other experiences purchased on the Site are non-refundable. Canobie Lake Park does not offer refunds or returns. Canobie Lake Park may occasionally offer discounts on the Site, it is available as is only at the time the order is placed. Pricing adjustments will not be made for previous orders based on past or future promotions or sale prices. 

Refunds for guests who mistakenly purchased a ticket for a child less than 4 years of age (48 months), for Senior Citizens (over 60 years of age) charged the general admission price at the main gate, for families with a valid military ID who did not receive a military discount, or for families who claim to have been overcharged, et al., must be done in person the same day as the park visit. In these cases, the guest in question must present their main gate admission receipt or online confirmation to Guest Services in order for refunds to be processed. We cannot issue a refund for these circumstances after the guest leaves park property.

Rain checks will be given to Guests who are in the Park at the time the Park decides to adjust closure time due to weather. Guests who have exited through our Main Gate prior to the Park’s adjusted closing time will not receive a rain check. 

Refunds will not be given due to heavy park attendance.  Refunds will not be given regardless of the amount of rides or attractions a guest (child or adult) has participated in while on park property. Refunds and/or discounts will not be given due to the closure, refurbishment, or mechanical breakdown of any ride, attraction or other experience. Refunds will not be given if a guest is ejected due to violating Canobie Lake Park’s Park Policy as outlined on our website and park signage. 

Exchanges: Any guests looking to request their ticket to be used on a different date than originally intended, can email info@canobie.com for assistance. Requests may not always be accepted and will be dealt with on a case by case basis. All tickets will scan valid on days with an equal or lesser value of the ticket that was purchased. Tickets will not scan valid if the tickets for that day are priced higher than the value of the ticket previously purchased. Guests will need to upgrade their ticket and pay the upgrade fee which does vary day to day and year to year.

Assumption of Risk: Guest assumes the risks associated with the operation of all rides and attractions and should read and obey any and all safety signage, instructions and rules. Canobie Lake Park assumes no responsibility for accident or loss to any person in connection with the program or use of the Park, rides, and amusements or their entrance into or departure from the Park. Any claim of injury or loss by a Canobie Lake Park Program Participant at the shall be litigated in Rockingham County, New Hampshire.

 

Communications:  If you participate in our Season Pass Program, Canobie Club Program, or any one of our other programs,  participants may receive periodic mailers, e-mails, newsletters and other communications about Canobie Lake Park, it’s affiliated products and services and select third-party offers including information about events, products, opportunities, services and special offers and discounts available. These communications may be sent by postal mail or by email, based on the contact information provided to Canobie Lake Park. You may opt out using a link at the bottom of each email. Please be aware that if you do not allow us to send you certain communications we will not be able to deliver any information to you about special Program Participant events and opportunities, or about products and services.

 

Your Obligations: In consideration of your use of this Site, you agree that to the extent you provide personal information to Canobie Lake Park,  it will be true, accurate, current, and complete and that you will update all personal information as necessary.

To the extent you create an account through this Site, you understand and agree that any account you create, including your username and password, are personal to you and may not be used by anyone else. You are responsible for maintaining the confidentiality of your username and password and are fully responsible for all activities that occur under your username and password by you or by anyone else using your username and password, whether or not authorized by you. You agree to change your password immediately if you believe your password may have been compromised or used without authorization. You also agree to immediately inform us of any apparent breaches of security such as loss, theft or unauthorized disclosure or use of your username or password by contacting us by email at info@canobie.com or by phone at 603-893-3506. Until we are so notified you will remain liable for any unauthorized use of your account.

You agree to use this Site in a manner consistent with any and all applicable rules and regulations. You agree not to upload or transmit through this Site any computer viruses, trojan horses, worms or anything else designed to interfere with, interrupt or disrupt the normal operating procedures of a computer. Any unauthorized modification, tampering or change of any information, or any interference with the availability of or access to this Site is strictly prohibited. We reserve all rights and remedies available to us.

Lost or Stolen Property: Canobie Lake Park is not responsible for lost or stolen property.

Third Party Benefits and Communications: Your information remains the sole property of Canobie Lake Park.  We will never sell or rent your information to anyone for any reason. Any third party promotion partner would emanate from and be administered directly through Canobie Lake Park’s communication portals. This  policy discloses the privacy practices for http://canobie.staging.mysites.io and affiliated Canobie Club email newsletter and official Canobie Lake Park social media activities. This privacy policy applies solely to information collected by the web site and/or other named activities. It includes the following:

  • What personally identifiable information is collected from you through the web site, how it is used and with whom it may be shared.
  • What choices are available to you regarding the use of your data.
  • The security procedures in place to protect the misuse of your information.
  • How you can correct any inaccuracies in the information.
  • Information Collection, Use, and Sharing
    • Canobie Lake Park is the sole owner of the information collected. We only have access to information that you voluntarily provide via email, submission forms or other direct contact from you.  We will not sell or rent this information to anyone.
    • We will use your information to respond to any contact from you. We will not share your information with any third party outside of our organization other than as necessary to fulfill your request, e.g. to ship an order or award a prize.
    • Unless you ask us not to, we may contact you via email in the future to tell you about specials, new products or services, or changes to this privacy policy.
  • Your Access To and Control Over Information
    • Information about you or your account will be provided by you to Canobie Lake Park for use in conjunction with the applicable program.
    • You may opt out of any future contacts from us at any time by:
      • Clicking on the unsubscribe link located at the bottom of each email.

  • Security
    • We take precautions to protect your information. We do not collect or ask you to submit sensitive information such as credit card data directly via our website, email newsletter or social media activities. Any data collected would be through you entering information onto a third party transaction portal falling under their own privacy and data use policies. Whatever information we collect from you is protected both online and offline using industry standards, etc.
    • Only employees who need to perform a specific job (for example, customer service) are granted access to personally identifiable information. The date is   in a secure environment.

These Terms of Use May Change

These Terms of Use are current as of the effective date set forth above.  Canobie Lake Park reserves the right to change these Terms of Use from time to time consistent with applicable laws and principles. These changes will be effective as of the date we post the revised version on this Site.  Your continued use of this Site after we have posted the revised Terms of Use constitutes your agreement to be bound by the revised Terms of Use. If at any time you choose not to accept these Terms of Use, you should not use this Site.
